These Terms and Conditions apply to all services and products offered by Bakhashwein Enterprises, including its brands Fon-Fix Repairs, CamAccess Technology, TrueSite Digital and RepairMatrix. By using our platforms, services, or products, you (“Customer”) agree to these Terms.
1.1 By accessing or using Bakhashwein Enterprises' websites, mobile apps, email communications, subscriptions, or other services (“Services”), you agree to these Terms.
1.2 We may amend these Terms at any time. The version in effect at the time of your use applies.
1.3 These Terms govern the use of services provided by:
1.4 By using our Services, you consent to the collection and use of your data for purposes such as processing orders, communicating offers (with consent), improving services, and complying with applicable laws.
1.5 You must be 18 years or older to use our Services.
2.1 Service Requests
2.1.1 Orders are deemed accepted when you submit a request and we confirm acceptance via email, SMS, or in writing.
2.1.2 Orders may require payment via designated methods.
2.2 Quotations and Pricing
2.2.1 Prices may vary due to supplier or operational changes before order acceptance.
2.2.2 All prices are exclusive of additional charges unless stated.
2.3 Cancellation and Refunds
2.3.1 Repair requests cannot be cancelled once the device is received and diagnosed.
2.3.2 Refunds are issued only if explicitly agreed upon.
3.1 Delivery of Products
Estimated delivery times are not guaranteed. Customers must provide accurate delivery information.
3.2 Installation Services
Customers must ensure proper site conditions. Delays due to customer readiness may incur additional charges.
4.1 Customers authorise Fon-Fix Repairs to perform necessary diagnostics and repairs.
4.2 Warranty is limited to workmanship for the period specified. Manufacturer warranties are passed to customers.
4.3 Limitation of Liability: our total liability shall not exceed the total amount paid for the service or product. This does not exclude liability for death, personal injury, or fraud caused by negligence.
5.1 All content, logos, graphics, software, and designs remain the property of Bakhashwein Enterprises and its respective brands.
5.2 Customers are granted a non-exclusive, non-transferable licence to use content for personal, non-commercial purposes only.
You agree not to use our services for illegal purposes, provide false information, infringe rights, or attempt to copy or reverse-engineer our systems, including RepairMatrix. You are responsible for account security.
Bakhashwein Enterprises may refuse or suspend service if you breach these Terms, engage in suspicious activity, or if required by law.
These Terms are governed by the laws of the Republic of Kenya. The Magistrates Court has exclusive jurisdiction over disputes.
9.1 Assignment: we may transfer our rights and obligations to third parties without affecting your rights.
9.2 No Partnership: compliance does not create a partnership or agency relationship.
9.3 Severability: invalid provisions do not affect remaining terms.
9.4 Entire Agreement: these Terms constitute the complete agreement between you and Bakhashwein Enterprises.
